Fairway Health & Wellness ("Fairway," "we," "our," or "us") is committed to protecting your privacy. Fairway is a marketing, administrative, and referral platform that connects customers to independent third-party partners offering services in Sleep, Bladder and Pelvic Health, Nutrition, and Exercise (the "Partner Services"). Fairway does not practice medicine and does not itself provide healthcare or clinical services. This Privacy Policy explains what information Fairway collects, how that information is used, and when your information is instead collected and controlled by an independent partner.

Sleep

Whether you complete a sleep assessment depends on how you come to us:

· Self-Assessment: if you come to us directly, without a referral from another physician, you must complete sleep assessment questionnaires (the STOP-BANG and Epworth Sleepiness Scale) on our website as well as a pre-consult.

· Physician Referral: if you are referred by another healthcare provider,you complete the sleep assessment, which will be transmitted to iSleep along with your referring physician’s order.

How you pay determines who bills you:

· Cash Pay: you pay Fairway directly for your pre-consultation and sleep test.

· Insurance Pay: your insurance information is transmitted to iSleep, who bills your insurance carrier directly. Fairway does not process payment in this case.

In all cases, we transmit your assessment or referral information, along with your demographic information, to our independent clinical partner, iSleep, under a Business Associate Agreement (BAA). As soon as iSleep has received your STOP-BANG and Epworth Sleepiness Scale responses, our system automatically deletes them after 30 days; we do not keep a copy after transmission.

Bladder and Pelvic Health

You first complete a brief, anonymous questionnaire to help you determine whether our partner’s program is right for you. This is an educational and behavioral-modification program, not a medical treatment. We do not ask for your name or any other identifying information as part of this questionnaire; our system does not save your answers, and they are automatically deleted as soon as your recommendation is generated. If you decide to proceed, you then purchase the program directly on our website, which requires your name, contact, and payment information. After payment, we send you a link to access our independent partner’s services.

Exercise

You first complete a brief, anonymous assessment to help generate a program recommendation. We do not ask for your name or any other identifying information as part of this assessment, our system does not save your answers, and they are automatically deleted as soon as your recommendation is generated. If you decide to proceed, you then purchase the program directly on our website, which requires your name, contact, and payment information. After payment, we send you a link to access our independent partner’s services.

Nutrition

You complete a brief, anonymous questionnaire to help educate you about nutrition and determine which products, or whether supplementation, may be right for you. We do not ask for your name or any other identifying information, our system does not save your answers, and they are automatically deleted as soon as your recommendation is generated. You are then directed to our independent partner, Nu Skin, to purchase products directly; you pay Nu Skin, not Fairway, and Fairway does not collect any personal information in connection with this referral.

Where we collect information, we use it to:

· Process your purchase and schedule your Sleep consultation and test (cash pay), or transmit your insurance information to iSleep so they can bill your insurance carrier directly (insurance pay)

· Transmit your Sleep assessment information (self-assessment) or your referring physician’s order (physician referral), along with your demographic and insurance information as applicable, to iSleep

· Generate in-the-moment, anonymous program or product recommendations, and educate you about nutrition, for Bladder and Pelvic Health, Exercise, and Nutrition

· Process your purchase of the Bladder and Pelvic Health or Exercise program and send you a link to access our partner’s services

· Communicate with you about your order

· Improve our website and user experience

· Comply with legal and regulatory requirements

Fairway is not a healthcare provider and does not practice medicine. With respect to our Sleep service (self-assessment or physician referral; cash pay or insurance pay), Fairway acts as a Business Associate under a Business Associate Agreement with iSleep, our independent clinical partner, and handles the assessment, referral, demographic, and insurance information you provide in that capacity, consistent with the Health Insurance Portability and Accountability Act (HIPAA). Our Bladder and Pelvic Health, Exercise, and Nutrition offerings are educational, behavioral, and product-referral services, not medical treatment. While we collect standard payment and contact information to process purchases for Bladder and Pelvic Health and Exercise, we do not collect or retain Protected Health Information in connection with those services or with Nutrition.

We do not sell your personal or health information.

We share information only as follows:

· Sleep: we transmit your assessment information (self-assessment) or your referring physician’s order (physician referral), along with your demographic and insurance information as applicable, to iSleep so they can interpret your results, process your referral, and — for insurance-pay patients — bill your insurance carrier directly.

· Payment processing: billing information for Sleep cash-pay, Bladder and Pelvic Health, and Exercise purchases is shared with our payment processor to complete your transaction.

· Regulatory authorities: if required by law.

For Bladder and Pelvic Health and Exercise, Fairway does not transmit your name, contact, or payment information to our independent partner. After you pay, we send you a link to access the partner’s services directly; any information you choose to provide the partner at that point is collected and controlled by them, not Fairway. For Nutrition, Fairway does not collect or share any information at all, because none is collected in the first place.

We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, disclosure, or misuse.

When you are directed to or access an independent partner’s website — for Bladder and Pelvic Health, Exercise, or Nutrition — any information you provide there is collected and controlled by that partner, not Fairway. That partner’s own privacy policy governs their use of your information. We encourage you to review the applicable partner’s privacy policy before providing information on their site. Our website may also contain other links to third-party websites; we are not responsible for their privacy practices.

· Sleep – Self-Assessment: as soon as we transmit your STOP-BANG and Epworth Sleepiness Scale responses to iSleep, our system automatically deletes them after 30 days, regardless of whether you are paying by cash or insurance. We do not retain a copy after transmission.

· Sleep – Physician Referral: we retain your referring physician’s order and related information as needed to support your care, process your referral, and comply with applicable recordkeeping and legal obligations.

· Sleep – demographic and insurance information: retained as needed to support your care, process your insurance (if applicable), and comply with applicable recordkeeping and legal obligations.

· Sleep – billing and payment information (cash pay): retained as needed to complete your transaction and comply with our recordkeeping and legal obligations.

· Bladder and Pelvic Health and Exercise: we do not retain your assessment answers at all — they are used only in the moment to generate your recommendation and are automatically deleted immediately after. Billing and payment information collected at purchase is retained as needed to complete your transaction and comply with our recordkeeping and legal obligations.

· Nutrition: we do not retain your questionnaire answers at all, and we do not collect any other information in connection with this referral.

We implement reasonable administrative, technical, and physical safeguards to protect the information we collect from unauthorized access, disclosure, or misuse, including industry-standard safeguards for payment card information.

With respect to information Fairway holds about you, you may:

· Request access to your personal information

· Request corrections to inaccurate information

· Request deletion of your information where permitted by law

These rights generally apply to your Sleep demographic, insurance, physician-referral, and billing information, and to your Bladder and Pelvic Health and Exercise billing and account information. Fairway does not retain Sleep self-assessment answers after transmission to iSleep, Bladder and Pelvic Health or Exercise assessment answers, or Nutrition questionnaire answers, so there is no such Fairway-held information to access, correct, or delete for those items. For information held by iSleep or another independent partner, please contact that partner directly.
